1. Introduction
This Privacy Policy (“Policy”) describes how LANDWAY INC., a corporation organized under the laws of the State of North Carolina, with its principal place of business at 2300 Brandywine Drive, Lenoir City, Tennessee 37772 (“LANDWAY,” “Company,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information in connection with our website located at www.landwayinc.com (the “Site”) and our related recruiting, hiring, and business activities.
By visiting the Site, submitting a form, or otherwise providing information to LANDWAY, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, please do not use the Site or submit personal information to us.
The Site and our services are intended for individuals who are at least 18 years of age. LANDWAY does not knowingly collect personal information from individuals under 18 (see Section 11).
2. Information We Collect
2.1 Information You Provide Directly
Depending on which form you use, we may collect:
- General Inquiry / Contact Form: name, email address, phone number, company name (if applicable), and the content of your message.
- Driver Application Form: name, contact information, desired position or route, general driving experience, and general employment history.
- Employment / Office Candidate Form: name, contact information, resume or CV, cover letter, and position of interest.
- Partner / Client Inquiry Form: company name, contact person, contact information, and the nature of your inquiry.
The forms available directly on the Site are designed to collect only preliminary contact information. LANDWAY does not collect Social Security numbers, driver’s license numbers, medical information, drug or alcohol testing results, or similar sensitive information through the public forms on the Site. Where such information is required later in the hiring process (for example, to complete a full driver application or to conduct a background check), it is collected through a separate, protected process, and additional disclosures will be provided to you at that time.
2.2 Information Collected Automatically
When you visit the Site, the hosting service may process technical request information, such as IP address, browser information and request time, to deliver and protect the Site. Google Analytics, Meta Pixel and LinkedIn Insight Tag are used only with their respective optional consent. Fonts and logo images are hosted locally.
2.3 Information From Other Sources
- Information submitted through third-party form providers, landing-page tools, or lead-generation services that LANDWAY uses to collect inquiries.
- In the future, information that external recruiting agencies or staffing partners may provide to LANDWAY about candidates they represent, which will be subject to separate data-sharing agreements with those partners (see Section 6).
3. How We Use Information
LANDWAY uses the information described above to:
- Respond to inquiries submitted through the Site and communicate with visitors, candidates, and partners.
- Evaluate candidates for driver and office positions and manage the hiring process.
- Communicate with candidates and partners by phone, email, and text message (SMS), consistent with the consent you provide (see Section 4 and any separate SMS consent disclosure presented at the point of collection).
- Arrange background checks through third-party consumer reporting agencies, where legally authorized and consented to by the candidate.
- Operate, maintain, secure, and improve the Site.
- Analyze Site traffic and measure the performance of our marketing and advertising campaigns.
- Comply with applicable legal, regulatory, and contractual obligations, including those of the U.S. Department of Transportation (“DOT”) and the Federal Motor Carrier Safety Administration (“FMCSA”) that apply to commercial motor carriers and drivers.
- Protect the rights, property, and safety of LANDWAY, our personnel, applicants, partners, and other individuals.
4. Cookies and Online Advertising
With your consent, Google Analytics 4 (Google LLC) measures site visits, referral sources and site actions. We do not send names, email addresses, phone numbers, ZIP codes or other application fields to Analytics. The tag is blocked until consent; you may withdraw using Privacy choices in the footer. Online identifiers and device information may be processed by Google. Google signals and Google advertising personalization are disabled. With separate advertising consent, Meta Pixel sends page views and successful-application events to Meta Platforms, Inc. Meta also receives IP address, browser information, page data and online identifiers for advertising measurement. We do not send application fields or use automatic advanced matching. Advertising is blocked by Global Privacy Control. You may withdraw consent using Privacy choices. See the Meta Privacy Policy. LinkedIn Insight Tag (LinkedIn Corporation) measures homepage visits and successful driver-inquiry submissions after advertising consent. LinkedIn receives the page URL, referral information, IP address, browser/device information, timestamps and online identifiers, and can use these for advertising measurement and website audiences. Its cookies and first-party LinkedIn Ads ID support attribution. We do not provide application field values or enable Enhanced Matching. The tag runs in a removable measurement frame; withdrawing Advertising consent removes that runtime without clearing the application form. Already transmitted data cannot be recalled, and third-party cookies must be managed through your browser or LinkedIn settings. See the LinkedIn Privacy Policy and Cookie Policy. 5. No Sale of Personal Information
LANDWAY does not sell personal information to third parties in exchange for monetary payment. Consented analytics and Meta/LinkedIn advertising measurement are described in Section 4. Advertising measurement may constitute sharing for cross-context behavioural advertising; reject Advertising in Privacy choices to opt out.
6. How We Share Information
LANDWAY may share personal information with the following categories of recipients:
- Service providers who support the operation of the Site and our business, including our website hosting provider and our email/SMS communications provider (SendSay).
- Analytics and advertising platforms identified in Section 4, for the purposes described there.
- Applicant tracking, HR, or CRM systems that LANDWAY may adopt in the future to manage candidate and employee information.
- Background check provider: StarPoint Screening (520 East Zaragoza St., Pensacola, FL 32502; www.starpointscreening.com), a consumer reporting agency engaged to conduct pre-employment driver and employment background checks, subject to the federal Fair Credit Reporting Act (“FCRA”) and applicable state law. If LANDWAY engages an additional or different provider in the future, this Policy will be updated accordingly.
- Insurance providers, in connection with commercial auto and liability insurance relevant to our operations.
- Recruiting partners: LANDWAY does not currently share candidate data with external recruiting agencies, but may do so in the future under written agreements requiring appropriate confidentiality and data protection commitments.
- Government authorities and regulators, including DOT and FMCSA, and law enforcement, where required by law, regulation, legal process, or to protect the rights, property, or safety of LANDWAY or others.
- A successor entity in connection with a merger, acquisition, financing, reorganization, or sale of some or all of LANDWAY’s assets.
LANDWAY requires its service providers to use personal information only to provide services to LANDWAY and not for their own independent purposes, except as otherwise required by law.
7. Data Retention
LANDWAY retains personal information only for as long as reasonably necessary for the purposes described in this Policy. As a general guideline:
- General inquiry or contact form submissions: up to 24 months from the date of your last contact with us, unless a longer period is needed to resolve an ongoing inquiry or dispute.
- Applications that do not result in hire (driver or office positions): up to 2 years from the date of application, after which the information is deleted or de-identified, unless a longer period is required by law or you consent to being considered for future openings.
- Personnel and driver qualification records for hired employees: for the duration of employment, plus any additional period required by DOT/FMCSA regulations and other applicable recordkeeping laws (generally up to 3 years following separation for driver qualification files, or longer where required).
- Background check reports: retained only as long as necessary for the purpose for which they were obtained, consistent with the FCRA and our agreement with the applicable consumer reporting agency.
- Marketing or recruiting email list data: until you unsubscribe or request deletion.
LANDWAY may retain information for longer periods where necessary to comply with a legal obligation, resolve a dispute, or enforce our agreements.
8. Data Security
LANDWAY implements reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, or disclosure. However, no method of transmission over the internet or method of electronic storage is completely secure, and LANDWAY cannot guarantee absolute security of information submitted to us.
9. Your Choices and Rights
Depending on your state of residence, applicable law may give you rights to access, correct, or request deletion of your personal information, and to opt out of certain uses of your data. As of the effective date of this Policy, LANDWAY does not meet the revenue or data-volume thresholds that trigger comprehensive state consumer privacy statutes currently in effect (such as those in California, Colorado, Connecticut, Virginia, and Tennessee). Nonetheless, as a matter of practice, LANDWAY will make reasonable efforts to respond to requests to access, correct, or delete personal information.
To exercise these choices, or with any privacy question, please contact us using the information in Section 14. You may also:
- Reply STOP to any text message from LANDWAY to opt out of further SMS communications.
- Use the unsubscribe link included in any marketing email, or contact us directly, to opt out of email marketing.
LANDWAY will periodically review whether changes in the size of its business or in applicable state law require additional state-specific privacy disclosures, and will update this Policy accordingly.
10. Job Applicants and Commercial Drivers
Additional information about how LANDWAY collects, uses, and discloses personal information from job applicants and commercial driver candidates — including information related to full employment applications, background checks, and the FMCSA Drug & Alcohol Clearinghouse — is, or will be, provided in a separate Applicant and Driver Privacy Notice presented during the application process. That notice supplements, and should be read together with, this Policy.
11. Children’s Privacy
The Site is not directed to individuals under the age of 18, and LANDWAY does not knowingly collect personal information from anyone under 18. All driver and employment positions at LANDWAY require applicants to be adults. If LANDWAY learns that it has inadvertently collected personal information from a minor, it will take reasonable steps to delete that information.
12. Third-Party Links
The Site may contain links to third-party websites, including job boards, social media platforms, and partner websites. LANDWAY is not responsible for the privacy practices or content of those third-party websites, and we encourage you to review their privacy policies before providing them with information.
13. Changes to This Policy
LANDWAY may update this Policy from time to time to reflect changes in our practices, our business, or applicable law. The “Last Updated” date at the top of this Policy indicates when it was most recently revised. Material changes will be reflected on this page, and, where appropriate, we will provide additional notice.

Application delivery and security
When application submission is enabled, information you submit is received and stored by our Cloudflare-hosted application service, copied to a restricted Google Workspace spreadsheet, and delivered to our recruiting team by email through Google Apps Script. A recovery copy and delivery status allow us to retry interrupted delivery. We also retain your optional SMS-consent choice, the consent text version and the submission time. Submission does not automatically send you text messages.
Cloudflare Turnstile helps protect the form against automated abuse. The application service checks email-domain mail configuration using Cloudflare DNS; only the domain portion is sent in that DNS lookup. This does not verify that your individual mailbox exists. Phone and ZIP checks verify format, not ownership or postal assignment. Technical request information is used for security; the application database does not store raw IP addresses. If submission is unavailable, the form does not display a successful receipt.
